It’s Not You… It’s U.S.

With all the rules and regulations that have passed regarding vaping as of late, we understand that it can be confusing to know what exactly has changed. The Trump administration has signed two pieces of legislation from the U.S. Food and Drug Administration that may impact the way that you vape. These laws were passed in order to prevent underage nicotine use as well as prevent a black market from emerging. We’re here to help clarify any questions you may have about the recent laws that affect vapers. Always remember to vape responsibly.

U.S. LEGAL VAPING AGE IS 21+ YEARS OLD

On December 20, 2019, the federal legal smoking age was raised from 18 to 21. This affects everyone across the United States and went into effect immediately. If you are under the age of 21, you will not be allowed to purchase any tobacco products. This includes e-liquid, e-cigarettes, and any form of combustible tobacco such as cigars and cigarettes. The Trump administration passed this after months of pressure from the public to solve the teenage vaping crisis. Prior to this ruling, many states already had laws that prohibited tobacco sales to those under the age of 21. FLAVOR BAN ON CARTRIDGE-BASED E-CIGARETTES

On January 2, 2020, the FDA released an industry guidance document for Electronic Nicotine Delivery Systems (ENDS). Many people have been led to believe that all flavors will be banned, but that is NOT the case. 

The FDA is banning flavored, cartridge-based e-cigarettes such as the JUUL device. This includes any device that uses non-refillable pods that you discard afterward. The only cartridges that will be allowed under this new ruling are those that are menthol or tobacco flavored. Although flavors are no longer allowed in cartridge ENDS, there has not been any legislation passed regarding disposables, freebase, and salt e-liquids. 

What does this mean for vapers? If you use a traditional open tank mod, you can still purchase flavored e-liquids as long as you are over the age of 21. You are still able to purchase disposables as well, as they are “completely self-contained” devices, but remember to vape responsibly. You can refer to the official FDA statement here.

SUMMARY

We understand that this can be a lot to take in so here are the cliff notes. In the United States:

  • You can only purchase e-cigarette and tobacco products if you are over the age of 21.
  • Flavored cartridges such as those used in JUUL devices are banned. The only legal flavors are tobacco and menthol for these devices.
  • Flavored freebase and salt e-liquids are legal for use in open tank systems (e.g. mods) and sub-ohm devices.
  • Disposable vape devices that do not have interchangeable pods with nicotine (self-contained vaping devices) are still legal.
